DACA Guide Chapter 4 Summary: Multiple Courts Prevent President Trump from Repealing DACA

January 12, 2021

Almost immediately after President Trump announced his intention to end DACA, federal lawsuits were filed and the public outcry poured into the streets with protests in major cities such as Los Angeles, Chicago, and Washington D.C. President Obama and Senator John McCain were among the many politicians who expressed public support for DREAMers, with Senator McCain stating that the recission of DACA is an “unacceptable reversal of promises and opportunities.” The long and winding road that the DACA lawsuits take is discussed in this chapter along with the decision in Trump v. NAACP, and the controversial appointment of Secretary of Homeland Security, Chad Wolf. A federal judge’s scathing opinion stating that Wolf did not have the authority to issue a memorandum relating to any immigration law as he was unlawfully serving in the position is also discussed in this chapter. This led to the ruling that DACA be reinstated in its original form.
