Venezuelans Granted the Ability to Apply for Temporary Protected Status

The current living conditions of Venezuela are unstable and unsafe for the people who live there. If you are from Venezuela and are currently in the United States, then you may be able to postpone your date to return to Venezuela by applying for Temporary Protected Status (TPS) from the United States government. WHAT IS TEMPORARY PROTECTED STATUS?


Temporary Protected Status (TPS) is a temporary designation that is given to nationals of countries that are currently facing armed conflict or natural disaster. If a country is designated for TPS by the Department of Homeland Security (DHS), then citizens of that country that are currently in the United States can apply to postpone their return home. TPS designation typically lasts for up to 18 months but can be extended at will by DHS. It is common for TPS designations to extend in periods of war within a country.


If you are successful in your TPS application, you will then be granted two major things:


  • Your departure from the United States will be postponed for up to 18 months, and 
  • You will be given the legal authority to work while you are living here in the United States.


You will have to file a Form I-821, Application for Temporary Protected Status if you are seeking protection under TPS. You will also need to include a Form I-765 to request employment authorization. You can, of course, do this on your own; but it is always recommended that you at least speak to an attorney before you decide how to move forward.


HOW TEMPORARY PROTECTED STATUS CAN BE HELPFUL FOR VENEZUELAN CITIZENS IN THE UNITED STATES


On March 9, 2021, DHS announced that Venezuela is under a TPS designation for a period of 18 months, until September 9, 2022. If you plan to apply for TPS as a Venezuelan citizen, then you have a 6-month registration period to apply for TPS that expires on September 5, 2021. 


If you are a national of Venezuela and are currently in the United States, then you are likely fearful of returning home to the unsafe and unstable conditions there. It is important to know that a TPS designation only allows you the opportunity to apply for TPS, as you are not guaranteed to get TPS status. You will not be eligible for TPS designation if you have been convicted of a felony or two or more misdemeanors.
